Vietnam provides detailed guidance on implementation of new Land Law

On 29 June 2024, the National Assembly of Vietnam amended the Land Law No. 31/2024/QH15 (“Land Law”), the Law on Real Estate Business 2023, and the Law on Residential Housing 2023 to bring forward their effective date from 1 January 2025 to 1 August 2024. These laws introduce significant changes to Vietnam’s real estate framework. Guidance decrees were issued on 1 August 2024 with immediate effect in order to aid the effective implementation of the Land Law.

This article highlights key issues of the Land Law, with specific reference to Decree No. 102/2024/ND-CP on the detailed implementation of a number of the Land Law’s articles and Decree No. 103/2024/ND-CP on land use fees and land rental.
