Indonesia finally has a new Criminal Code - Shedding the last vestiges of colonialism?

Indonesia’s House of Representatives passed Indonesia’s long-debated new Criminal Code bill on 6 December 2022 (“New Criminal Code”). The New Criminal Code covers broader topics than the old Criminal Code and now extends to include certain corporate matters. One example of the expansion of corporate liability is that when a corporation commits a crime, now the “controlling shareholder” and the “beneficial owners” of such corporation may also be exposed to criminal liability. The New Criminal Code has also expanded into the bedroom, with certain (limited) prohibitions on premarital sex, and other prohibitions, including slandering or insulting the president or government.
