Malaysia Competition Commission consults on proposed mandatory merger control regime in Malaysia, and other changes

On 25 April 2022, the Malaysia Competition Commission (“MyCC”) initiated a public consultation on MyCC’s proposed amendments (“Proposed Amendments”) to the Competition Act 2010, including the introduction of a mandatory pre-notification regime for mergers that meet the prescribed threshold, and a voluntary pre-notification regime for mergers that do not meet the prescribed threshold.
The public consultation is expected to close on 25 May 2022.
MyCC expects the Proposed Amendments to be tabled in Parliament by October 2022, with all non-merger control-related provisions coming into force by December 2022 (should the amendments be passed in Parliament). The merger control-related provisions are expected to come into force only at a much later date (i.e. tentatively by October 2023).
