Nalli Pte Ltd & Ors v Nalli Kuppuswami Chetti and Nalli Ramanathan (trading as Nalli Chinnasami Chetty) & Anor [2024] SGHC(A) 18

In the recent decision of Nalli Pte Ltd & Ors v Nalli Kuppuswami Chetti and Nalli Ramanathan (trading as Nalli Chinnasami Chetty) & Anor, the Appellate Division of the High Court (“Appellate Division”) overturned the findings of the General Division of the High Court (“General Division”) that the appellants were liable for, among other things, trade mark infringement. This decision marks the first reported decision of the Appellate Division overturning a lower court’s findings regarding trade mark identicality and similarity.
